I. Certifying Legal Acts
i. Certifying Contracts & Agreements
1. Certifying the selling or transfer of right of land utilization, house transfer, sales and equity transfer
1) For the part below 500,000RMB, 0.3% will be charged as Notary Service Fee, with the minimum charge at 200RMB;
2) For the part above 500,001RMB and below 5,000,000RMB, 0.25% will be charged;
3) For the part above 5,000,001RMB and below 10,000,000RMB, 0.2% will be charged;
4) For the part above 10,000,001RMB and below 20,000,000RMB, 0.15% will be charged;
5) For the part above 20,000,0001RMB and below 50,000,000 RMB, 0.1% will be charged;
6) For the part above 50,000,0001RMB and below 100,000,000 RMB, 0.05% will be charged;
7) And for the part above 100,000,001RMB, 0.01% will be charged.
2. Certifying other economic contracts
1) For the part below 20,000RMB, 1% will be charged;
2) For the part above 20,001RMB and below 50,000RMB, 0.8% will be charged;
3) For the part above 50,001RMB and below 100,000RMB, 0.6% will be charged;
4) For the part above 100,001RMB and below 500,000RMB, 0.5% will be charged;
5) For the part above 500,001RMB and below 1,000,000RMB, 0.4% will be charged;
6) For the part above 1,000,001RMB and below 2,000,000RMB, 0.3% will be charged;
7) For the part above 2,000,001RMB and below 3,000,000RMB, 0.2% will be charged;
8) For the part above 3,000,001RMB and below 4,000,000RMB, 0.1% will be charged;
9) And for the part above 4,000,001RMB, 0.05% will be charged.
3. Certifying civil agreements
1) Non-property Civil Agreements
Such as: Maintenance Agreement, Support Agreement, Agreement on Change of Right of Support, Foster Care Agreement, Custody Agreement, and Adoption Renouncement Agreement, etc. 200RMB will be charged for each case.
2) Civil Agreements involving property relations
Such as: Marriage Settlement, Heritage Division Agreement, Private Lending or Repayment Agreement, Premarital Agreement on Property, Marital Property Agreement, Property Division Agreement in Divorce, and Housing Demolition and Relocation, Resettlement Agreement, etc. 400RMB will be charged for each case.
ii. Certifying Adoption
1. Placed out for adoption by biological parents, 500RMB will be charged for each case;
2. Placed out for adoption by any one of the biological parents, 800RMB will be charged for each case;
3. Placed out for adoption by other guardians, 1000RMB will be charged for each case;
4. 1000RMB will be charged for each de facto adoption case.
iii. Certifying property inheritance, gift of property and bequest
When the benefit amount is below 200,000RMB, maximum 1.2% will be charged;
For the part above 200,000RMB and below 500,000RMB, maximum 1% will be charged;
For the part above 500,000RMB and below 5,000,000RMB, maximum 0.8% will be charged;
For the part above 5,000,000RMB and below 10,000,000RMB, maximum 0.5% will be charged;
For the part above 10,000,000RMB, maximum 0.1% will be charged;
If the case is to certify a unilateral gift or unilateral recipient, the charge will be only half of the standards listed above, minimum 200RMB.
II. Certifying facts that have legal significance
i. Certifying birth, existence, death, identity, experience, education background, nationality, marital status, family relations, and never being or had being subjected to any criminal punishment, etc. 80RMB will be charged for each case.
ii. Certifying qualification or credit of legal person or other organizations, 500RMB will be charged for each case.
iii. Certifying events of Force Majeure, 400RMB will be charged for each case.
iv. Evidence Preservation
1. Preservation of testimony of witness and documentary evidence, 200RMB will be charged for each case;
2. Preservation of audio and video materials, computer software, 800RMB will be charged for each case;
3. Preservation of Materials
1) Preservation of real estate, 1000RMB will be charged for each case;
2) Preservation of other material evidences, 400RMB will be charged for each case;
4. Preservation of torts and factual evidence, 1000RMB will be charged for each case.
v. For issuing Bill Protest, 400RMB will be charged for each case.
III. Certifying documents with legal significance
i. Certifying the documents on enjoyment, transfer and use of intellectual property, 500RMB will be charged for each case.
ii. Certifying other documents with legal significance
1. Certifying the letter of attorney, articles of association, meeting decision or other legal documents of legal persons or other organizations, 500RMB will be charged for each case;
2. Certifying other documents with legal significance, such as duplicates, abridged edition, translation, photocopies match with original; and certifying signatures and stamps on legal instruments are genuine, 80RMB will be charged for each case.
IV. Drawing Notarization will be charged per the 0.3% of subject amount, minimum 100RMB. Custody fee paid on behalf of client will be charged separately.
V. Entrusting compulsory execution effect to instrument of creditor's claims, 0.3% of the total amount due will be charged.
VI. Notarization of will, preservation of will, counting and keeping legacy, and confirmation of the validity of wills
1. Notarization of will, 400RMB will be charged for each case;
2. Preservation of will, 10RMB/case/month will be charged;
3. Counting legacy will be charged per Item VII.
4. Keeping legacy will be charged per negotiation with client;
5. Confirmation of the validity of wills, 500RMB will be charged for each case.
VII. Notarization of counting, liquidation, assessment and loss assessment of property
1. For individual clients, 450RMB will be charged for each case;
2. For legal persons or other economic organizations, 2500RMB will be charged for each case.
VIII. The establishment, alteration and termination of other civil juristic acts
1. Notarial Supervision
1) For auctions, 2500RMB will be charged for each case;
2) For tenders, 2500RMB will be charged for each case;
3) For notarial supervision at awards decision and lottery, 2500RMB will be charged for each case;
4) Sampling inspection of commodity, 900RMB will be charged for each case;
5) Others, 1800RMB will be charged for each case.
2. Unilateral civil legal acts of citizens such as statement, letter of attorney, 200RMB will be charged for each case.
IX. Preservation of documents, handling mortgage registration as regulated by laws, handling registration and certification affairs related with the notarization matter, drafting and modifying legal instruments related with the notarization matter, respond to legal consultations
1. Preservation of documents, 10RMB/case/month;
2. Mortgage registration notarization, 400RMB will be charged for each case;
3. Registration affairs related with the notarization matter, 400RMB will be charged for each case;
4. Certification affairs related with the notarization matter, 100RMB will be charged for each case;
5. Drafting legal instruments related with the notarization matter
1) For civil cases, 100RMB – 180RMB will be charged for each case;
2) For economic cases, 500RMB – 900RMB will be charged for each case
6. Modifying legal instruments related with the notarization matter
1) For civil cases, 50RMB – 100RMB will be charged for each case;
2) For economic cases, 200RMB – 500RMB will be charged for each case
7. For responding to legal consultations, 50RMB/hour will be charged (consultations less than one hour will still be regarded as a full hour).
X. Other legal affairs handled in accordance with laws
1. Certifying administrative contracts and agreements, such as Family Planning Agreement and Homestead Utilization Agreement, 30RMB will be charged for each case;
2. Processing fee for translation is 20RMB for each case;
3. Duplicates of notarial certificate
1) Duplicates with no translation, 10RMB/copy;
2) Duplicates with translation, 20RMB/copy.
4. Consulting archives of notarization files, 50RMB/file/time;
5. If serving as perennial legal counsel, the notary office will sign agreements with clients and charge based on mutual negotiations;
6. If providing comprehensive notary and legal services in large and complicated legal affairs, the charge will be determined based on mutual negotiations.
7. Charges for issuing Legal Opinions will be determined based on mutual negotiations.
XI. In accordance with Clause Seven in “Notary Service Fee Management Regulations”, the appraisal cost, assessment fee, travel expense, and investigation fees, etc. which should be paid by client shall be paid by client, in the way of reimbursing actual cost or lump sum price, which is to be negotiated between notary office and client before signing agreements.
XII. For notarization matters accepted by notary office, if client requests to withdraw then administration fees shall be charged.
If not examined, 10RMB will be charged for each case. If examined, the case will be charged at 50% of the standard service fee. |
