英文原文 PART II----GENERAL CONDITIONSExamination Of Premises Each Contractor shall examine the Site and area and compare its findings with the Drawings and Specifications, and shall inform and satisfy itself as to all matters necessary for its carrying out the work, including but not limited to, general working conditions, labor requirements, accessibility, condition of the premises, obstructions, etc. The Contractor shall investigate all other conditions as to character of the Site and character of existing structures at or adjacent to the Site, and the character and extent of the Owner and other Contractors’operations in the area, and in connection with the Project, and shall take all these matters into account in submitting its bid. No allowance or extra payment will be subsequently made because of any such items or conditions occasioned by the Contractor failure to make such comparison and examination on account of interference from the Owner and other Contractors’activities, including, without limitation, the activities of the Contractor, or by reason of any error or oversight on the Contractor part. Definition Architect-Engineer -- means the United Architecture Design Institue (UA) Bid Documents ?? means these documents shall only include Drawings, Specifications (including General Conditions and Special Terms and Conditions) and Bulletins issued and dated on or before the date of contract with the Owner approval. Bulletin -- means a request for quotation issued by the Owner to the Contractor. Business Day -- means any day except Sundays and statutory and public holidays in the PRC Change Order -- means the authorization for a change to scope of work (which may be an addition or a deduction) of the Contract. China -- means the People's Republic of China Contract -- means the contract to which these General Conditions apply. Contractor -- means any party having direct Contract with the Owner. Drawings -- means the drawings attached to the Contract. Emergency Field Order -- means a document issued by the Owner which authorizes the Contractor to proceed immediately with the work described therein with the price to be determined. Field Representative -- means the Architect-Engineer employee designated to represent the Architect-Engineer at the Site. The function of the Architect-Engineer is to assure the Owner that the project shall be completed in full compliance with the requirements of the Drawings and Specifications. This Representative is instructed to give the Contractor all assistance in interpreting the Drawings and Specifications. This assistance shall not relieve the Contractor from any responsibility for the work. Any faulty work must be corrected by the Contractor.Although this Representative may have permitted faulty work or work done not in accordance with the Drawings and Specifications, the Owner shall not be prevented from insisting upon the Contractor fully completing the work as specified. Main Contractor -- means the Contractor designated by the Owner as Main Contractor. Materialman ?? means any Person, other than a Subcontractor, providing goods or services in connection with the Project. Owner:BeijingDulwichInternationalSchool (BDIS) Owner's Representative – URS Consulting (Shanghai) Co., Ltd. Person -- means any individual, company, corporation, partnership, joint venture company, governmental authority or any other entity. Project -- means the engineering, procurement and installation of the facilities. The Project is generally described in the Bid Documents and is more particularly described in the Drawings and Specifications Site -- means the land on which work is to be performed. Special Conditions -- means the Special Conditions, if any, applicable to the Contract. Specifications -- means the specifications attached to the Contract. Subcontractor -- means any Person engaged pursuant to a subcontract by the Contractor, with the Owner's written consent, to assume a portion of a contract from a Contractor and to construct a portion of the work required to complete the Project Superintendent ?? means a representative who shall have authority to act for the General Contractor, Contractor or Subcontractor, respectively. 3. 定义 3.1 建筑师-工程师——指联合建筑设计协会(UA) 3.2 招标文件——指包括图纸、说明(包括通用条件及专用条件和条款)、在合同生效日前或当天发布的业主批准并注明日期的通告。 3.3 通告——指业主向承包商发出的报价要求。 3.4 工作日——除周六周日及其它中华人民共和国法定假日外的日子。 3.5 变更通知——指对本合同工作量(可以是增加也可以是减少)做出变更的授权。 3.6 中国——指中华人民共和国。 3.7 合同——指该通用条件适用的合同。 3.8 承包商——指与业主有直接合同关系的任何一方。 3.9 施工图纸——指本合同附带的图纸。 3.10 紧急现场通知——指业主发布的授权承包商按照指定工程(价格待定)进行施工的文件。 3.11 现场代表——指由建筑师-工程师指派到现场代表建筑师-工程师的雇员。建筑师-工程师的职责是向业主确保该项目能完全按照施工图纸和施工说明完成。现场代表在图纸和说明的解释方面给予承包商所有的支持。这种支持不应免除承包商对于该工程的任何责任。任何缺陷工作都应由承包商改正。 尽管该现场代表可能允许缺陷工作或为按照图纸和说明施工,但业主有权坚持承包商完全按照规定完成工作。 3.12 主承包商——指由业主指定的作为主承包商的承包商。 3.13 材料人员——指除分包商外的,任何提供与该项目相关的产品和服务的人员。 3.14 业主——北京德威英国国际学校(BDIS)。 3.15 业主代表——URS咨询(上海)有限公司。 3.16 法人——指任何个人、公司、企业、合伙企业、合资公司、政府主管部门或其它实体。 3.17 项目——指各种设施的设计、采购和安装。该项目在招标文件中有概括的描述,在施工图纸和施工说明中有详尽的描述。 3.18 现场——指该工程实施的场地。 3.19 专用条款——指如果有的话,适用与本合同的专用条款。 3.20 施工说明——指本合同后附的施工说明。 3.21 分包商——指与承包商签订分包合同并获得业主书面同意,来执行从承包商处获得的一部分合同额,并建造完成该项目所需的这一部分工程的任何法人。 3.22 主管——指能分别代表总承包商、承包商或分包商行使权利的代表人。 3.23 人民币——指中华人民共和国的合法流通货币。
