四、本规定由国家旅游局和商务部共同负责解释。4. The “Regulations” shall be jointly interpreted by National Tourism Administration and Ministry of Commerce.

五、本规定自2006年1月1日起实施。5. The “Regulations” shall be enforced since January 1, 2006.
旅行社管理条例  Management Rules for Travel Agency
根据2001年12月11日《国务院关于修改〈旅行社管理条例〉的决定》修订）(Amended according to “Decision of the State Council on ‘Management Rules for Travel Agency’” formulated on December 11, 2001.

第一章 总则Chapter 1 General Provisions
第一条 为了加强对旅行社的管理，保障旅游者和旅行社的合法权益，维护旅游市场秩序，促进旅游业的健康发展，制定本条例。Article 1 The “Rules” are hereby formulated to strengthen management of travel agency, safeguard legitimate rights and interest of tourists and travel agency, maintain tourism market order and promote healthy development of tourism industry.

第二条 本条例适用于中华人民共和国境内设立的旅行社和外国旅行社在中华人民共和国境内设立的常驻机构（以下简称外国旅行社常驻机构）。Article 2 “The Rules” are applicable travel agencies established inside PRC and the standing agency established by foreign travel agency in PRC (hereinafter referred to standing agency of foreign travel agency).

第三条 本条例所称旅行社，是指有营利目的，从事旅游业务的企业。Article 3 Travel agencies termed in the “The Rules” refers to enterprises engaged in tourism with purpose of making profit.

本条例所称旅游业务，是指为旅游者代办出境、入境和签证手续，招徕、接待旅游者，为旅游者安排食宿等有偿服务的经营活动。Tourism business termed in the “The Rules” refers to compensated service such as going through exit-entry formalities and visa formalities for tourists, receive tourists and arrange boarding and accommodation for tourists etc..

第四条 国务院旅游行政主管部门负责全国旅行社的监督管理工作。Article 4 The tourism administrative authority of the State Council takes charge of supervision and management of travel agencies nationwide.

县级以上地方人民政府管理旅游工作的部门按照职责负责本行政区域内的旅行社的监督管理工作。Department in charge of management of tourism of people’s government at the county level and above shall take charge of supervision and management of travel agencies inside the administrative region according to their duties.

本条第一款、第二款规定的部门统称旅游行政管理部门。The departments provided for in paragraph 1 and 2 are collectively called tourism administration department.

第五条 旅行社按照经营业务范围，分为国际旅行社和国内旅行社。本条例另有特别规定的，依照其规定。Article 5 Except otherwise specially provided for in the rules, travel agencies are divided into international travel agency and domestic travel agency according to scope of business.

国际旅行社的经营范围包括入境旅游业务、出境旅游业务、国内旅游业务。Scope of business of the international travel agency includes entry tourism business, exit tourism business and domestic tourism business.

国内旅行社的经营范围仅限于国内旅游业务。The scope of business of domestic travel agency are limited to domestic tourism business.
