四、废标界定
Ⅳ. Definition of Waste Bid
实质上没有响应招标文件要求的投标将被拒绝。投标人不得通过修正或撤销不合理要求的偏离或保留，从而使其投标成为实质上响应的投标。如发现下列情况之一的，其投标将被拒绝：
The bid without substantial responses to the requirements of the bid documents will be rejected.  The tenderer shall not change its bid into one with substantial responses to relevant requirements through correcting or cancelling deviation or reservation inconsistent with relevant requirements.  The bid shall be rejected in any of the following cases:
A、投标人未提交投标保证金（投标保函）或金额不足、保函有效期不足、投标保证金（投标保函）的形式、格式或投标保函出证银行不符合招标文件要求的；
A. The tenderer fails to submit the bidding security(bidding guarantee) or its amount is insufficient, the validity period of the guarantee is inadequate, or the form or format of the bidding security(bidding guarantee) or the issuing bank of the bidding guarantee is inconsistent with the requirements of the bid documents;
B、不满足招标文件第二册中投标人资格标准的；
B. The tendering document to meet the qualification standards for the tenderers provided for in volume 2 of the bid documents;
C、投标人的投标书或资格证明文件未提供或不符合招标文件要求的；
C.The bidding documents or the qualification certificates have not been provided by the tenderer or are inconsistent with the requirements of the bid documents;
D、投标文件未按照要求逐页小签的；
D. The tender documents have not been executed page by page according to requirements;
E、投标文件无法定代表人签字，或签字人无法定代表人有效授权书的；
E. The tender documents bears no signature of the legal representative, or the signatory does not have valid letter of attorney by the legal representative;

F、投标有效期不足的；
F. The validity period of the bid is insufficient;
G、未提供分项报价的。

H、不满足付款条件要求的；
H. The bid does not meet the requirements for payment;
I、不满足招标文件《第八章 货物需求一览表及技术规格》中加注*号的重要技术参数要求的；
I . The bid does not meet the requirements for key technical parameters indicated with “*” in “Chapter 8  List of Demand for Goods and Technical Specifications” in the tendering documents.
J、投标人所提供的货物及服务的遗漏部分超过其投标总价的10％时；
J. The percentage of the goods or service omitted in those provided by the tenderer exceeds 10% of its total bidding price；
K、在投标文件中提供虚假文件和/或资料的；
K. The tenderer provides false documents and/or materials in the tender documents.；
L、投标文件符合招标文件中规定废标的其他技术条款或商务条款的；
L. The tender documents is consistent with the other technical provisions or commercial provisions for waste bid provided for in the bid documents；
M、投标文件中附有招标文件要求以外不公平性条件的；
M. The tender documents bears unfair conditions beyond requirements of the tendering documents.
N、投标人采取相互串标，排挤其他投标人的不公平竞争，损害招标人或其他投标人的合法权益的；
N. The tenderers damages the legitimate interests of the tenderee or other tenderers through unfair competition such as mutual complicity in bid and pushing out other tenderers；
O、投标人以行贿手段谋取中标或者以其他弄虚作假方式投标，违反国家法律及相关法令法规的。
O. The tenderer seeks to win the bid by means of bribery or bid through practicing fraud or violates the state laws and relevant orders and rules.
