劳动合同书 Labor Contract
根据《中华人民共和国劳动法》，甲乙双方经平等协商同意，自愿签订本合同，共同遵守本合同所列条款。 Both parties come to an agreement on basis of equality and willingness and in accordance with Labor law of PRC and relevant regulations and laws, both parties shall abide by the agreement as below:
一、劳动合同期限1. Terms of the labor contract

二、工作内容2. Working Contents
第二条  乙方同意根据甲方工作需要，在     部门，担任   岗位工作。Article 2  Party B agrees to act as          according to party A’s working requirements .甲方可根据工作需要调整乙方的工作岗位。Party A can adjust Party B’s working position according to Party A’s working requirements.
 
第三条  乙方应按照工作岗位职责的要求按质按量完成工作。Article 3  Party B shall complete the work meeting with the quality demands according to the requirements of position description.
三、劳动保护和劳动条件3. Labor protection and Labor Conditions
第四条  甲方安排乙方执行定时工作制或综合计算工时工作制。Article 4  Party A arranges Party B to implement Fixed Working Hours or Cumulatively Calculated Working Hours。执行综合计算工时工作制的，平均日和平均周工作时间不超过法定标准工作时间。If the Cumulatively Calculated Working Hours is implemented, the working time of average day and average week shall not be over the statutory working time. 甲方安排乙方加班应符合国家和北京市有关加班工时的规定。Party A shall comply with the national and Beijing Municipal regulations concerned over-time working when Party A needs Party B over time work.
第五条 甲方为乙方提供必要的工作条件和工具，建立健全工作流程，制定操作规程、工作规范和劳动安全卫生制度及其标准。Article 5 Party A shall provide necessary labor conditions and labor tools, establish and perfect production technology, work out operation regulation, work rules and labor safety hygiene system.

甲方按照国家或北京市有关部门的规定组织安排乙方进行健康检查。Party A shall arrange Party B to perform health evaluation compliance with the national or Beijing Municipal relevant regulations.
第六条  甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的教育和培训。Article 6  Party A shall be liable for education of occupation moral, business skills, labor safety, labor disciplines and party A’s rules.
四、劳动报酬4. Labor Remuneration
第七条  甲方的工资分配遵循按劳分配原则。Article 7  Party B’s wage distribution shall be compliance with the Principle of Distribution System According to Labor. 甲方可根据乙方的工作表现、工作绩效调整乙方的劳动报酬。Party A can adjust Party B’s remuneration according to Party B work performance.
第八条  甲方每月28日以货币形式支付乙方工资，工资不低于北京市最低工资标准，工资分配水平在岗位协议中约定。Article 8  Party A shall pay Party B wage in money on 28 of every month. The wage shall not be lower than the Beijing Municipal minimum wages standard and the wage distribution level is agreed on the Position Agreement.个人所得税及应由个人负担的各项保险金、工资分配水平在岗位协议中约定。Individual income tax, the insurance fee that shall be borne by individual and wage distribution level is agreed in the Position Agreement.个人所得税及应由个人负担的各项保险金、住房公积金由公司依法扣缴。Individual income tax and the insurance fee & housing accumulation fund that should be borne by individual is withheld by the company according to the law.
第九条  由于甲方生产任务不足，使乙方下岗待工的，甲方保证乙方的月生活费不低于北京市月最低生活费标准。Article 9  In case that party B waits for the work due to party A’s insufficient work arrangement, Party A shall guarantee Party B’s monthly living expenditure not lower than Beijing monthly minimum living expenditure standard.
 
五、保险福利待逼5. Insurance and Welfare Treatment
第十条  甲乙双方应按国家和北京市社会保险的有关规定缴纳职工养老、失业、大病、工伤保险费用及住房公积金。Article 10  Both parties shall pay the insurance fee for Endowment, Unemployment, Health, Work Injury and the housing accumulation fund according to national and Beijing Municipal social insurance regulations.
第十一条  乙方因式负伤的医疗期及医疗期的保险福利待遇甲方按国家和北京市有关规定执行。Article 11 In case that party Be is injured from work, the medical treatment shall be subject to national and Beijing Municipal relevant regulations. 
乙方患病或非因工负伤的医疗期及医疗期的保险福利待遇，甲方按国家和北京市有关政策执行。 In case that party B is sick or injured not from work, the medical treatment shall be subject to national and Beijing’s regulations.
