六、劳动纪律6. Labor disciplines
第十二条  甲乙双方都要自学遵守中华人民共和国及北京市政府的法律规定。Article 12  Both parties shall comply with the national and Beijing Municipal laws and regulations 乙方应遵守甲方依法制定的规章制度:严格遵守劳动安全卫生, 操作规程和和工作规范 ,爱护甲方财产,遵守职业道德,严守商业秘密,积极参加甲方组织的培训,提高思想觉悟和职业技能。 Party B shall abide by labor disciplines and regulations, labor safety hygiene, production technology, operation regulations, work regulations, protect party A’s property, comply with occupation moral, take part in party A’s training and improve self-quality.
第十三条  乙方违反甲方劳动纪律,甲方可依据本单位规章制度,给予纪律处分,直至解除本合同。Article 13  In case that party B violates all rules and disciplines formulated by party A, party A is entitled to handle and even terminate the contract in accordance with rules and regulations.
七、劳动合同的变更、解除、终止、续订7. Alternation, release, renewal and termination of the labor contract
第十四条  订立本合同所依据的法律、行政法规、规章发生变化时,本合同应变更相关内容。Article 14  In the case that the law and administrative regulations is changed, this contract shall be changed accordingly.
第十五条  订立本合同所依据的客观情况发生重大变化,致使本合同无法履行时,经甲乙双方协商同意,可以变更本合同的相关内容。Article 15  When the objective conditions taken as the basis for the conclusion of the contract have greatly changed, the original labor contract can no longer be carried out. By the agreement of both parties, the contract relevant content can be altered.

第十六条  经甲乙双方协商一致,本合同可以解除。Article 16  Both parties agree to alter the contract.,this contract can be terminated.
第十七条  乙方有下列情形之一,甲方可以解除劳动合同:Article 17  Party A may terminate the contract at any time under any of the following circumstances:
1、在试用期间,被证明不符合录用条件的;1、Party B is not qualified to requirement by Party A during the probationary periods.;
2、违反劳动纪律或甲方规章制度的;2、Party B severely violates any of Party A’s rules or disciplines;
3、工作失职、营私舞弊,对甲方利益造成重大损害的;3、Party B neglects duty or commits jobbery and causes great loss on Party A’s interests;
4、被依法追究型事责任的。4、Party B is investigated in accordance with criminal law.
第十八条  有下列情形之一,甲方要以解除劳动合同,但应提前三十日以书面形式通知乙方:Aritcle 18  In any of the events, this contract may be terminated by Party A on 30 days’ prior written notice to Party B:
1、乙方患病或非因工负伤,医疗期满后,不能从事原工作,也不能从事由甲方另行安排的工作的;1、Party B is unable to take up his original work or any new work arranged by Party A after the completion of the medical treatment for illness or injury not suffered at work.;
2、乙方不能胜任工作,经过培训或调整工作岗位仍不能胜任工作的;2、Party B is incompetent for the work and stays so even after training or position adjustment.;
3、双方不能依据本合同第十五条规定就变更合同达成协议的;3、Party A and Party B can not come to an agreement for the contract alteration according to Article 15 of this contract;
4、企业生产经营状况发生严重困难或宣告破产解散,在法定整顿期间,确需裁人的;4 The company operation is in critical difficulties or announces the bankruptcy and dismissal and really needs to reduce the staff during the statutory reorganization period;
5、企业因经营或生产技术条件发生变化而人员有富余的。5 The staff is enough or spare resulted from the company operation and technical condition change.
第十九 乙方具有下列情况之一的,甲方不得解除或终止劳动合同;Article 19  In any of the events, Party A must not terminate the contract;
1、因工负伤并被确认丧失或者部分丧失劳动能力的;1、Injured from work and is confirmed for loss or partial loss of labor ability;
2、患病或者非因工负伤,在规定的医疗期内的;2、Party B is incapacitated for illness or injury not from performing the duties and is in the medical treatment term.;
3、女职工在孕期、产期、哺乳期的;3、Party B is in the period of pregnancy, confinement or lactation;
4、法律、行政法规规定的其它情形。4、Other conditions that stipulated by laws and administrative regulations.
 
第二十条  乙方解除本合同,应当提前三十日以书面形式通知甲方。Article 20  Party B shall notify party A 30 days before party B terminates the contract in written form
有下列情形之一,乙方可以随时通知甲方解除本合同: In any of the events, this contract may be terminated by Party B with prior notice::
1、在试用期内;1、Within the probation period;
2、甲方以暴力、威胁、监禁或者非法限制人身自由的手段强迫劳动的;2、Party A forces Party B’s to work by resorting to violence, intimidation or illegal restriction of personal freedom.;
3、甲方不能按照本合同规定支付劳动报酬或者提供工作条件的。3、Failure on the part of Party A to pay remuneration or to provide working conditions as agreed upon in the employment contract..
第二十一条 本合同期限届满,劳动合同即终止。Article 21  This contact expires, the labor contract is terminated. 甲乙双方经协商同意,可以续订劳动合同。This contract can be renewed based on both party’s agreement through negotiation.
