承租人因自身原因,向出租人提出提前终止TD0154号《房屋租赁合同》(以下简称〈合同〉)。The lessee, due to its own reasons, has notified the lessor that it determines to terminate the TD0154 House Rental Contract (hereinafter the “Contract”) before expiration.
经出租人与承租人双方协商。Through mutual negotiation between the lessor and the lessee, 就提前终止〈合同〉及其相关事宜达成以下一致意见:the parties hereto have agreed as follows in respect of the termination of the Contract before expiration and relevant matters:
1. 依据〈合同〉中关于免租期的约定:“……若<合同>提前终止,则应在合同终止之日以后发生的、而承租人尚未享有的免租期不再生效,出租人亦不对承租人进行费用补偿。In accordance with the agreement (under the Contract) concerning the rental free period, if the Contract is terminated before expiration, the rental free period that should occur after the termination date of the Contract and has not been enjoyed by the lessee yet shall no longer be effective, nor will the lessor compensate the fees to the lessee.若承租人合同期未满解除〈合同〉时,则承租人应按〈合同〉约定的房屋租金单价向出租人全额补交已享受的免租期间的房屋租金。If the lessee terminates the Contract before expiration, the lessee shall pay the lessor with the house rent for the free rental period already enjoyed by the lessee in accordance with the unit price of the house rent as agreed in the Contract. ”依据上述条款,承租人应向出租人补交以下时段的房屋租金: In accordance with the aforesaid clauses, the lessee shall pay the following house rents to the lessor:
(1) 2005年2月21日至2005年4月7日期间的房屋租金;the house rent for the period from February 21, 2005 to April 7, 2005
上述款项合计人民币266,897.40元,出租人将从承租人已交纳的租房押金中扣除,押金剩余部分(RMB194,499.60元)出租人将于2006年11月10日退还承租人。The sum of the aforesaid amounts is RMB 266,897.40 Yuan, which shall be deducted by the lessor from the rental deposit already paid by the lessee, and the balance (RMB194,499.60 Yuan) of the deposit will be returned by the lessor to the lessee on November 10, 2006.
2. 出租人原则同意承租人承租的腾达大厦7层01/02/03/09B/10/11房间租金及物业管理费交至2006年8月10日,承租人须于2006年8月15日办理完毕交房手续,并结清8月15日之前所发生的、但尚未向出租人支付的电费、电话费以及其他费用。The lessor agrees in principle that the house rent and the property management fee for the 01/02/03/09B/10/11 room(s) of the seventh floor of the Tengda Mansion rented by the lessee shall be paid until August 10, 2006, and the lessee shall finish all formalities for returning the rented room(s) back to the lessor before August 15, 2006, and shall settle with the lessor all the power rates, phone rates and other fees and expenses that occur prior to August 15, 2006 and have not been paid to the lessor yet. 若承租人未能如期交还租房间,则出租人将按照原租赁条件(房屋租金及物业管理费为RMB4.2元/日/平方米)从2006年8月16日继续计算承租人所发生的房屋租金、物业管理费等所有费用,直至承租人迁出为止。If the lessee fails to return the rented room(s) in due time, the lessor shall be entitled to continue to charge house rent and property management fee and other fees against the lessee from August 16, 2006 in accordance with the original rental conditions (the house rent and the property management fee shall be RMB 4.2 Yuan per square meter per day) until the lessee moves out of the rented room(s).

3. 由于承租人自身原因,无法于2006年8月15日前将所租房间内的办公桌椅迁出,出租人同意在承租人于2006年8月15日交房时,将办公桌椅暂存于7层01/02/03/09/10/11房间内,存放时间最迟不得超过2006年8月31日。If the office desks and chairs fail to be moved out of the rented room(s) before August 15, 2006 due to the lessee’s own reasons, the lessor agrees that the lessee may, when it returns the house on August 15, 2006, temporally store the office desks and chairs in the rooms 01/02/03/09/10/11 of the seventh floor no later than August 31, 2006.若暂存期内出租人已将上述房间出租,且承租人尚未迁出办公桌椅,出租人有权将办公桌椅移至其他地点并由承租人支付保管费。If the lessor rents out the aforesaid room(s) within the temporary storing period, and the lessee has not moved out the office desks and chairs, the lessor shall be entitled to move the office desks and chairs to other locations and the lessee shall pay the storage fee.
4. 承租人搬离腾达大厦7层01/02/03/09/10/11房间时,应严格按照〈合同〉及其附件的相关规定执行,否则,承租人应赔偿其给出租人造成的一切损失。The lessee shall move out of the rooms 01/02/03/09/10/11 of the seventh floor of the Tengda Mansion in strict compliance with applicable provisions of the Contract and its Attachments, otherwise, the lessee shall indemnify the lessor for all losses caused to the lessor.
5. 本终止协议为TD0154号〈房屋租赁合同〉项下双方权利义务的最终解决。This Termination Agreement shall be the final settlement of the rights and obligations of the parties hereto under the TD0154 House Rental Contract. 双方基于〈合同〉的权利义务就此终止。The rights and obligations of the parties hereto under the Contract shall be terminated here and now.除本终止协议的约定外,双方不得基于〈合同〉要求对方进行任何赔偿或支付任何费用。Except provided in the agreements under this Termination Agreement, neither party may request the other party to make any indemnity or pay any fee on the basis of the Contract.
6. 本补充协议一式两份,出租人与承租人各持一份。This Termination Agreement shall be made in duplicate, each of the lessor and the lessee holding one.{0>本协议自双方签字盖章之日起生效。<}0{>This Agreement shall enter into force upon seal and signature of each of the Parties hereto.<0}
