(i)(i)  if the Property is subject to an Encumbrance at the Closing Date, then the Operator shall assume the Owners’ obligations under such Encumbrance in exchange for an assignment by the Operator on behalf of the Owners (and the Purchaser hereby appoints the Operator as its true and lawful attorney for such purposes) to the Operator of any income payable thereunder, and the other provisions of this Section 3(b) shall apply as between the Purchaser and the Operator mutatis mutandis;如果财产在交割日时受限于一项他物权,则操作员应该在这样的他物权下承担起业主们的责任,由操作员代表业主们的利益(买方因此指定操作员就此目的作为其真实合法的代理人)换取一份转让,将项下任何可支付收益转让给操作员,并且此3(b)部分的其它条款做必要修正后应在买方和操作员之间适用。
