After equal and free will negotiation, the parties hereby make the following alteration to the present labor contract under effective performance.
经甲乙双方平等自愿、协商同意,对双方已经签订的现行有效履行的劳动合同做以下变更:
1. Alter Article 1 “This contract is a term labor contract. This contract comes into force on and the probation period shall ends on . This contract terminates on ”into “This contract is a labor contract without fixed term. The probation period is 3 months and will end on .”
1. 改第一条“本合同为 期限劳动合同。本合同于 年 月 日生效,其中试用期至 年 月 日止。本合同于 终止。”为“本合同为无固定期限劳动合同。试用期三个月,试用期至 年 月 日止。
2. Alter “the salary of Party B during the probation period shall be 80% of the official salary” of Article 8 into “the salary of Party B during the probation period shall be 100% of the official salary. Party A has the right to adjust the salary of Party B considering the business situation of the company and Party B’s work.”
2.改第八条中“乙方在试用期间的工资为正式工资的80%”为“乙方在试用期间的工资为正式工资的100%。甲方有权根据公司的经营状况和乙方的工作情况调整乙方的工资”。
3. Alter “if Party B passes the annual performance examination of Party A, Party A shall pay Party B the salary of the last month of the annual performance examination as bonus. But if any of the parties proposes to terminate the labor contract, there shall be no such bonus” of paragraph 1 of Article 8 into “if Party B gets 3 or over 3 points for the annual performance examination, Party A shall pay Party B the salary of the previous month of the annual performance examination as bonus; if Party B gets 2 points, 80% of the salary of the previous month of the annual performance examination shall be paid as bonus; and if Party B gets lower than 2 points, there shall be no such bonus.”
3. 改第八条 1、中的“乙方年终绩效考核被甲方通过时,甲方将以年终绩效考核时最后一个月工资为标准以福利方式奖励乙方。如果任何一方提出解除劳动合同,则不奖励一个月工资。”条款为“乙方年度绩效考核评分为3分或3分以上者,甲方将以乙方年度绩效考核时的前一个月工资为标准奖励乙方;乙方年度绩效考核评分为2分者,甲方将以乙方年度绩效考核时的前一个月工资的50%为标准奖励乙方;乙方年度绩效考核评分低于2分者,没有该项奖励。”
4. Alter “in the event Party A terminates labor contract for Party B’s breach of contract or Party B proposes to terminate the labor contract before the term expires, Party B shall repay to Party A the training fees and acceptance fees paid by Party A (if any). The training fee shall be calculates in the standard stipulated in training contract between the parties and acceptance fee shall include recruitment expenses incurred from employing Party B (including hunting fee) and the compensation that Party A paid for Party B to Party B’s former unit” of Article 36 into “an employee shall sign training contract with the company for any outside training demanded y the employee.” The former contract signed between the company and employees on inside and outside trainings shall be annulled on the day of the alteration of this contract.
4.改第三十六条“甲方出资培训和出资招接收的乙方,违反本合同的约定解除劳动合同或单方面提前解除劳动合同时应返还培训费和招接收费。培训费以甲乙双方签订的培训合同中的规定为标准:招接收费包括招聘乙方发生的招聘费(含猎头费)和甲方替乙方交纳给原单位的各类补偿金。”为“员工个人需求的外部培训需要与公司签订培训合同。”原已签订的公司要求员工进行的内外部培训合同自本合同变更之日起作废。

5. Alter “the annexes to this contract are as follows” of Article 41 into “the regulations and rules of AAAAA (Beijing) Co., Ltd. and employee manuals shall constitute annexes to labor contract”.
5.改第四十一条“本合同的附件如下 ”为“AAAAA(北京)有限公司的各项规章制度和员工手册作为劳动合同的附件。”
6. The altered provisions of the original labor contract lapses automatically and those not altered shall be still in force.
6.原劳动合同未变更部分继续有效,变更部分自动失效。
