Instructions about how to apply for will notarization

The procedure of Mandarin,Chinese, English certified translation, notarization, certification and legalization by Ministry of Foreign Affairs and the embassies:

1. Will definition
Will is a behavior, presented in writing or oral form in citizen’s lifetime, to designate one or several of the legal heirs, or the person excluded state, group or legal heirs to inherit personal property after testator’s death.
2. Will manifestation
The national “Inheritance Law” stipulates 5 forms of will making:
(1) Holograph will: It is written by testator, with testator’s signature, and specifying the year, month and date.
(2) Allograph will: when making the will, there will be two and above witnesses on site, written by one of the witnesses, specifying the year, month and date, and signature of the scrivener, other witnesses and testator.
(3) Recorded will: when making the will, there will be two and above witnesses on site.
(4) Oral will: when testator is in emergency case, the testator can make oral will, there will be two and above witnesses on site. Once emergency case is over, the testator has the ability to make written or recorded will, the oral will has made will be invalid.
(5) Notarial will: the testator make the will through public notary office.
3. The material which has to be submitted when making the will notary:
(1) The testator’s ID card and residence booklet;
(2) The property evidences of will dispose (such as house property certificate, deposit form and share certificates booklet).
(3) Notarized certificate of relationship issued by testator’s work unit (or orgnization, LANDS, party, DPA, veteran bureau, retired cadres). If the testator is widowed, whether has been married or not will be specified.
(4) If both of the husband and wife apply for a will, they have to provide marriage certificate or conjugal relations letter.
(5) The testator who is over 60 years or with physical discomfort, should provide diagnosis certificate of clear thinking issued by hospitals above the county level.
4. Precautions of will notary
(1) The will should represent the testator's true intention, the notary office will not notarize the will under stress of subsurface waterlogging or betray testator's true intention.
(2) The property which the will can dispose should be personal owned. If it is the public property, the will can only dispose the personal part.
(3) When making the will, the testator should reserve a certain share property to the inheritor who has no living ability.
(4) When the husband and wife, or other property owners are applying for will notarization simultaneously, they should handle the notarization individually, and dispose the property of their respective share, they can’t share only one piece of will.
(5) The testator can specify to left the property to individual beneficiary, rather than jointly owned by all the beneficiaries couple.
(6) Before the will enters into force, the testator can change or revoke the will according to the law. But the holograph will, allograph will, recorded will and oral will can’t change or revoke notarial will.
(7) Notary will determines whether tape or video recording need or not according to the testator’ situation.
(8) If the will is private, the testator himself has to keep it as confidentiality.
5. Notary fees
400 yuan/piece, copy version is 10 yuan /piece, recording cost is 50 yuan /person, video cost is 50 yuan /person, investigation cost is 100 yuan.
