Beijing Municipal House Rental Contract V4.2
Notes for signing this Contract:
1. Welcome to join ZIROOM! Before signing a contract on this app, you should 1) confirm that you’ve downloaded the latest version of contract; 2) fill up your personal information, qualification, rental period, and payment method, etc., as required by this app, and confirm that all the information you offered are legal, true, valid and complete; 3) read this Contract carefully, comprehend each article thoroughly (including but not limited to the information of the house, rental period, rent cost and other rights and obligations) and choose whether to agree or not. Your signing the Contract with this app will be regarded as you agree with all the articles of this Contract.
2. When you have started the payment (including the deposit, initial rent and service charge), the correspondent house will be engaged, please finish the payment within 10 minutes, otherwise this house will be released (the words “be released” here mean that this house will be released from engagement and become available again, other tenants can choose this house to sign the Contract with us. The same below). If you haven’t made a full payment, please pay for the balance within 48 hours, otherwise this house will be released, and you should pay 20% of the deposit to us as a default fine. After you have paid to us all the relevant fees and payments, please get the special receipt as indicated by ZIROOM and keep the payment receipt until the rental period expires. Please be especially noted that in order to guarantee your money safe, please do NOT pay to the individual agent in cash for any fees, including relevant rent, deposit, water, electricity and gas fees, etc., otherwise, you have to undertake all the consequences of possible losses in money. Online payment on ZIROOM’s website is strongly recommended for the abovementioned fees.
3. After finishing the payment, you should confirm with us on the delivery of this house within 48 hours, as indicated by the app, otherwise it will be regarded as you agree with the delivery details. After you finish your payment, if the house cannot be delivered due to failures in house engagement (including that this house has been released again) caused by disrupts or interruptions of the service, shutdowns of the system for maintenance or upgrade, or malfunctioning or unstable systems, and therefore this Contract cannot be signed by both sides, we promise to return the money of this deal back to your ZIROOM account within 24 hours, and compensate you in terms of money worth 10 times as daily interests of financing products for no less than 3 days based on the amount you paid (here the annual financing interest rate should be counted by 12%: daily interests=annual financing rate/365; “no less than 3 days” means thatif the time it takes to return the money you paid back to your ZIROOM account plus the time it takes to transfer the money from you ZIROOM account to your bank account upon your application for withdrawal is less than 3 days, then the compensation should be calculated by 3 days, otherwise the compensation should be calculated by the actual days, the same below). Taking 3 days as an example, the compensation should be calculated as follows: the paid sum*daily financing rate*10*3.
4. After you finish the signing of this Contract on this app and we confirm its correctness and then both sides complete the house delivery, this Contract will generate electronic document with electronic stamp which should have the legal right, so we don’t have to seal with the traditional stamp anymore. You may check it on the website of ZIROOM and download it for printing.
5. According to the Contract Law of the People’s Republic of China and related laws and regulations, this Contract is signed on the fair and voluntary basis by the real estate agency with house rental entrustment as Party A (namely the rental agency) and you (hereinafter referred to as Party B).
