7.3 Performance guarantee and technical parameters
7.3.1 General provisions
1) According to the performance guaranteed by manufacturer in tender documents, the Seller will implement a performance test within 60 days after the genset has been put into production; and if failed to reach guaranteed performance level, a forfeit will be imposed.
Requirements for genset performance test are as follows:
a. The Seller will implement performance test to each engine delivered. The purpose of test shows that under the on-site conditions when gas contents are as those stated in Article 2.5.1 of the Specification, the engine will be capable of continually operating at the output power, thermal consumption and NOx emission level guaranteed by its tenderer in relevant documents.
b. According to ambient temperature and methane contents, on the basis of modified factors or curves of ambient temperature and methane contents provided by the tenderer, these test results must be converted into the output power and thermal consumption in terms of conditions for guaranteed values.
c. The Seller shall implement 24 hours test of engine power for 60 days after initial operation, and take an average of 24-hour continuous output power of each engine as the rated power of the engine set. If the rate power of engine set is lower than guaranteed value, the Seller must pay forfeit for $1,200 per kW; and if the tested power of an engine set is lower than rated power by 5%, the Purchaser shall have the right to return the engine set for replacement and to require to retest the replaced engines, and all expenses occurred shall be borne by the Seller.
d. Take a reading per hour during NOx test and 24 readings for one engine; comparing the average with guaranteed values stated in tender document, if any engine has a result higher than guaranteed value, the tenderer must replace the engine for free.
e. Implement 24-hour test for thermal consumption of engine set, take the average as the thermal consumption level of the engine set for comparison with the guaranteed value; if the thermal consumption value tested is higher than guaranteed values, the Seller must pay forfeit at the rate of $200 per kJ/kWh for each engine set, and if thermal consumption tested of any engine set is higher than the guaranteed values by 5%, the Purchaser shall have the right to return the engine set and the Seller must replace it and retest its performance. In addition, thermal consumption test can be carried out in synchronism with output power test.
f. Under the on-site conditions, gas engine gensets provided by the Seller shall be consistent with the fuel gas conditions stated in Article 2.5.1 of Attachment 2-1 to this Technical Specification, and the power of tested engine, thermal consumption and NOx emission level shall be compared to those guaranteed by Article 4.3.1 and 6.3.3 of Attachment 2-2 to this Technical Specification.
2) Backing pressure of the engine set with full load (5kPa), and maximum permissible backing pressure for continuous operation (5kPa).
3) Average sound pressure level of surface noise measured at the place 1m from engine set shall comply with the provisions of DIN45635 Standards and national standards of the State.
4) Engine must be ensured that during the quality assurance period the engine can operate for at least 7,000 hours annually. If not, the Seller shall pay a forfeit at the rate of $10 per hour less.
5) During the quality and operation assurance period, if the Seller fails to provide spare components and parts duly and causes the engine not to generate electricity normally, a forfeit shall apply to the Seller. The amount of such forfeits can be calculated by multiplying the electricity loss with the price of electricity set by JCCOAL in that month.

7.3.4.2 Maintenance of Genset E60
E60 repair and maintenance within 30,000 hours caused by the reason that is not attributable to the Purchaser, all expenses occurred shall be borne by the Seller. However, expenses on the first E60 maintenance beyond 30,000 hours (including spare parts, labor cost etc.) shall be borne by the user at the quoted prices stated in tender documents of provider.
7.3 性能保证和技术参数
7.3.1总则
1）根据生产商在投标文件中保证的性能，在发电机组投入运行后60天内，卖方将进行性能测试，若达不到保证值要求，将予以罚款。
机组性能测试要求如下：
a.卖方将对供货的每台发动机进行性能测试。测试目的表明，在现场条件下，当瓦斯甲烷浓度为本规范“2.5.1”条款规定时，该发动机能连续提供其投标人在投标文件中所保证的输出功率、热耗值和NOx排放值达到保证值的要求。
b.将测试结果，根据环境温度和瓦斯甲烷浓度，按照投标人提供的环境温度和甲烷浓度的修正系数或曲线，换算成保证值所依据条件下的输出功率和热耗值。
c.对发动机功率将在初始运行60天内进行24小时测试，将每台发动机24小时连续输出功率取平均值，作为该发动机组的额定功率。如果发动机组的额定功率低于保证值，卖方将按照1200美元/kW支付罚款，若某一发动机组测试功率低于额定功率的5%，卖方将有权退回该发动机组，卖方将无偿更换该发动机组，并要求对更换的发动机进行重新测试。
d.Nox测试每小时采集一个读数，每台采集24个读数，取平均值与投标书中的保证值比较，若某一台测试结果超过保证值，投标人将无偿更换该发动机。
e.对发动机机组热耗将进行24小时测试，取平均值作为该发动机组的热耗值并与保证值比较，若机组测试的热耗值高于保证值，卖方将对每台机组按照每kJ/kWh支付200美元的罚款，如果某一台发动机组测试的热耗值高于热耗值5%，买方有权要求退回该发动机组，卖方将无偿更换该发动机，并要求进行重新测试。热耗值测试可与输出功率测试一同进行。
f.卖方提供燃气发动机发电机组在现场条件下，使用本技术规格附件2-1 “2.5.1”条款的燃料气条件，测试机组的功率、热耗值和NOx排放值，与本技术规格附件2-2中“4.3.1”和“6.3.3”的保证值比较。
2）机组满载背压值（5kPa），同时提供连续运行最大允许背压值（5kPa）。
3）距发动机组1m处测得的表面噪音平均压级符合DIN45635标准规定和中国标准的规定。
4）发动机保证在质量保证期内年运行时间不小于7000h。每少一个小时罚款10美元。
5）在质量保证期和运行保证期内若因备品备件不能及时供应而影响机组正常发电，则进行罚款。罚款的金额按损失的发电量乘以当月晋煤集团的综合电价进行罚款。

7.3.4.2机组E60保养
在非买方原因造成的需要在30000小时内做E60维修保养，所需费用全部由卖方负责承担。在30000小时以外所做的第一次E60保养费用（包括零配件、人工费用等）按供方的投标文件内有关报价提供给使用方。
