8.1 The Buyer or its representative is entitled to check and/or test the good, to confirm whether it complies with the criteria stipulated in the Contract, free of additional charges.   The Contract and the technical criteria shall provide that the Buyer required checking and testing, how and where the check and test shall be carried out.   The Buyer shall promptly notify the Seller in writing about the identity of representative to execute the check and/or test.

8.2 The check and test may be carried out at residence of the Seller or its subcontractors, the place of delivery or the final destination.   In the event the check and test is carried out at residence of the Seller or its subcontractors, the inspector shall have full access to all reasonable facilities and assistance, free of any additional charged for the Buyer.

8.3 If any goods fail to comply with the criteria after check and test, the Buyer can refuse to accept the same goods and the Seller shall replace the rejected goods, or modify the goods until satisfying the criteria without further charging.

8.4 The Buyer shall test the goods when the goods arrives at the destination port and／ or the delivery site.

8.5 Before delivery of goods, the Seller shall cause the manufacturer to conduct detailed and thought check on the quality, specification, function, quantity or weight of the goods and issue an inspection certificate to confirm that the goods comply with the Contract. The certificate shall be an integral part of the documents provided to the remitting bank for payment, but shall not be regarded as the final check of the quality, specification, function, quantity or weight.   The result and details of the manufacturer’s check shall be attached to the quality inspection certificate.

8.6 When the goods arrive at the destination port or the place of delivery the Buyer shall apply for the inspection of quality, specification or quantity from the Entry-Exit Inspection and Quarantine Bureau of People’s Republic of China (herein after referred to as “Inspection Bureau”.  If the Inspection Bureau finds any noncompliance of quality, specification or quantity, the Buyer is entitled to claim liability from the Seller within 90 days after the goods arrive at the place of delivery.

8.7 If the Inspection Bureau’s inspection result shows there is any noncompliance of quality or specification, or the goods are proved to be defective, including potential of defect or use of inappropriate material, within the warranty period stipulated in Article 18 in the Contract, the Buyer shall claim damages from the Seller in a timely fashion.

8.8 Article 8 shall not exempt the Seller’s warranty obligation and other obligations under this Contract.

9.1 The Seller shall deliver the goods to the final destination, which are packaged in the manner required by the Contract to prevent the goods from damage or deterioration during transportation.   Such packaging should be taken protective measures to protect the goods from moisture, sun, rust, corrosion, vibration and other damage, in order that the goods can withstand repeated handling, loading and ocean and inland long-distance transportation.  The Seller should bear all the liability and cost caused by the erosion, damage or loss of goods due to inappropriate packaging or protective measures.  For wood packaging material, it shall go through quarantine treatment and make a statement with IPPC special logo or a statement of no use of wood packaging material.

10.1 The Seller shall mark the following information on the adjacent four sides of each package box in inerasable paint and conspicuous English:

10.2 If a single package box weighs 2 ton or more, the Seller shall mark” Center of Gravity” and “Lifting Point” in both sides of the package box in English and transportation marks commonly used in international trade for the convenience of shipping, loading and moving.  According to the characteristics of the goods and different requirements for transportation, the Seller shall clearly mark “handle with care” “This Side Up, Do Not Invert” “Keep Dry” and other appropriate signs used in international trade.

8.6 货物抵达目的港和／或现场后，买方应向中华人民共和国国家出入境检验检疫局(以下称为“检验检疫局”)申请对货物的质量、规格、数量等进行检验，并出具交货后检验证书。如果检验检疫局发现质量、规格、数量等与合同规定不一致的地方，买方有权在货物到达现场后90日内向卖方提出索赔。

8.7 如果在合同条款第18条规定的保证期内，根据检验检疫局的检验结果，发现货物的质量或规格与合同要求不符，或货物被证实有缺陷，包括潜在的缺陷或使用不合适的材料，买方应及时向卖方提出索赔。

8.8 合同条款第8条的规定不能免除卖方在本合同项下的保证义务或其他义务。

9.1 卖方应提供货物运至合同规定的最终目的地所需要的包装，以防止货物在转运中损坏或变质。这类包装应采取防潮、防晒、防锈、防腐蚀、防震动及防止其它损坏的必要保护措施，从而保护货物能够经受多次搬运、装卸及远洋和内陆的长途运输。卖方应承担由于其包装或其防护措施不妥而引起货物锈蚀、损坏和丢失的任何损失的责任或费用。对于木质包装材料，应按照中华人民共和国国家质量监督检验检疫总局的规定，对木质包装进行除害处理并加施IPPC专用标识的声明或未使用木质包装的声明。

10.2 如果单件包装箱的重量在2吨(t)或2吨(t)以上，卖方应在包装箱两侧用英语和国际贸易通用的运输标记标注“重心”和“起吊点”，以便装卸和搬运。根据货物的特点和运输的不同要求，卖方应在包装箱上清楚地标注“小心轻放”、“此端朝上，请勿倒置”、“保持干燥”等字样和其他国际贸易中使用的适当标记。
