Technical Regulations on Kunming Municipal Urban Planning Management
Chapter 1 General Provisions
Article 1 To scientifically formulate urban planning, make urban planning management strict, achieve the standardization, normalization and institutionalization of urban planning design and planning management, and guarantee the legal implementation of urban planning, in accordance with “City Planning Law of the People’s Republic of China”, “Regulation son Yunnan Provincial Urban Planning Management”, “Regulations on Kunming Municipal Urban Planning Management” and the approved “Kunming Municipal General Planning”, as well as the relevant laws, regulations, rules and standards of the state, province and city, in the consideration of Kunming’s actualities, we hereby formulate the Regulations(hereinafter referred to as “the Regulations”).
Article 2 The Regulations apply to the urban planning, construction engineering design, planning management and other relevant activities conducted within the urban planning area of Kunming.
The formulation and examination & approval on sub-area planning, specific planning (including specific controlling planning and specific construction planning), various types of professional planning, and the relevant architectural design, shall abide by the relevant laws, regulations, rules and standards of the state, province and city, and the Regulations.
Different planning shall adopt the uniform coordinate system of the state.
The land utilization and different constructional activities within the planning area of Kunming shall abide by the approved specific planning; the specific planning that haven’t been approved, shall abide by the Regulations.
Article 3 the urban planning area of Kunming is determined according to the general urban planning of Kunming. For the area beyond urban planning area in Kunming, the Regulations shall be followed.
 
Chapter 2 Construction Land
Article 4 The classification and construction standard of Kunming construction land, shall follow the “Urban Land Classification and Planning Construction Land Standard” (GBJ 137-90).
Article 5 The classification of different construction lands shall follow the compatibility principle for land use, and executed according to the approved specific planning; if there isn’t any approved specific planning, it shall be executed according to the sub-area planning and the stipulations of Blank 2-1 in the Regulations.
For those construction projects not listed in the Blank 2-1, the urban planning management departments shall check and set their scopes suitable for construction according to environmental impact assessment conclusion and infrastructure conditions.
For those whose planning land nature needs to be changed, it shall be reported to the competent departments according to the regulated procedures and limits for examination & approval authority, and execute after approved
Article 6 the land layout in the planning area of main urban area, shall follow the principles of “tract development, supporting construction, green land increase, density reduce, and function adjustment”. 
Article 7 the land use nature within the second ring road of the urban main area mainly include financial, productive service industry, business office, and commercial trading and so on. The residential land shall be adjusted, and the market construction based on large-scaled storage commercial facilities and wholesale shall be strictly controlled. Factories, warehouses, and comprehensive large-scaled medical institutes etc shall not be newly built or expanded any longer.  
Within the protection scope of officially protected sites and buildings, no building shall be newly-built, and for those where newly-built building is necessary, they shall be in compliance with the requirements of the relevant protection laws, rules, standards and planning; the newly-built, re-built and expanded building within their surrounding construction-controlling zone, shall fit in with the officially protected sites and buildings, and meet the requirements of relevant protection planning.

昆明市城市规划管理技术规定
第一章  总 则
 
第一条  为科学编制城市规划,严格城市规划管理,实现城市规划设计和规划管理的标准化、规范化和法制化,保障依法实施城市规划,根据《中华人民共和国城市规划法》、《云南省城市规划管理条例》、《昆明市城市规划管理条例》和经批准的《昆明城市总体规划》,以及国家、省、市相关法律、法规、规范和标准,结合昆明市的实际情况,特制定本规定。
第二条  本规定适用于在昆明城市规划区内进行的城市规划、建设工程设计和规划管理的相关活动。
编制和审批分区规划、详细规划(含控制性详细规划和修建性详细规划)、各项专业规划以及有关建筑设计,应当符合国家、省、市相关法律、法规、规范、标准和本规定。
各项规划应当采用国家统一的坐标系统。
昆明城市规划区内的土地利用和各项建设活动应当符合经批准的详细规划;尚无经批准的详细规划的,应当符合本规定。
第三条  昆明城市规划区根据经批准的昆明城市总体规划确定。在本市范围内非城市规划区的区域,参照本规定执行。
 
第二章  建设用地
 
第四条  本市建设用地分类和建设标准,按照《城市用地分类与规划建设用地标准》(GBJ 137—90)执行。
第五条  各类建设用地的划分应当遵循土地使用相容性原则,按照经批准的详细规划执行;尚无经批准的详细规划的,按分区规划和本规定表2-1的规定执行。
凡表2-1中未列入的建设项目,由城市规划管理部门根据环境影响评价结论和基础设施条件,具体核定适建范围。
需改变规划用地性质的,应当按照规定程序和审批权限报有关机构批准后执行。
第六条  主城规划区内的用地布局,应当遵循“成片开发,配套建设,增加绿地,降低密度,调整功能”的原则。
第七条  主城二环路内用地性质以金融、生产性服务业、商务办公、商贸等为主,调整居住用地,严格控制大型仓储式商业设施和以批发为主的市场建设,不得再新建、扩建工厂、仓库和综合性大型医疗机构等设施。
在文物保护单位和建筑保护单位的保护范围内,不得新建建筑物,确需新建建筑物的,应当符合相关保护法规、规范、标准和规划的要求;在其周围建设控制地带内的新建、改建、扩建建筑物,应当与文物保护单位和保护建筑相协调,满足相关保护规划的要求。
