Controlling Indexes of Building Capacity

Article 8 Scale Regulation for the Construction Project Land within the Planning Area of Main Urban Area
(I) the land of the construction projects within the second ring road of the main urban area shall abide by the following regulations
1. Construction projects shall make overall development construction within the blocks enclosed with the planning road red line as wide as 15 cm or over 15 cm.
2. For the lands, for which overall block reconstruction can¡¯t be made, the surrounding developable lands within the same block shall be integrated. Technically its land scale shall be not smaller than 10 Mu, except the non-residential projects in the main commercial blocks.
3. For those whose land scale is smaller than 10 Mu, commercial residential projects shall not be developed and technically it shall be used for environmental landscaping, road, public facilities for public benefit and urban utilities construction etc.  
4. For the construction project land on the two sides of artery 40m or over 40m away from the planning road red line, the land depth beyond planning road red line shall not be smaller than 50m.
 (II) Construction project land beyond the second ring of the urban main area shall be in compliance with the following regulations
1. Technically the commercial residential project land for residence shall not be smaller than 50 Mu; and those smaller than 50 Mu, shall integrate with the surrounding lands as much as possible.
2. For the construction project land on the two sides of artery 40m or over 40m away from the planning road red line, the land depth beyond planning road red line shall not be smaller than 60m.
Article 9 the profit-oriented land whose scale fails to meet the stipulations of Article 8 shall be reported to the municipal competent departments for land resources management to make land resource integration, and after it meets the land scale demand, the municipal land resources management departments shall apply for land planning and designing requirements to the municipal planning management departments.
Article 10 within the scope of urban planning area, the requisitioned rural collectivity-owned land reserved as the living and production land for peasants according to the relevant policies due to the basic construction of the state shall be in compliance with the urban planning requirements, and technically they shall be arranged comparatively intensively.
 
Chapter 3 Controlling Indexes of Building Capacity
Article 11 The building capacity controlling indexes for the newly-built, re-built and expanded construction engineering ( including plot ratio and building density, the same below) shall abide by the stipulations of the Article. The maximum value of building capacity controlling indexes shall be in compliance with the stipulations in the Blank 3-1.
For the construction project that wholly rebuilds ¡°village in the city¡±, and dangerous and old buildings, the land development intensity can be properly improved if it meet the demand of urban planning and the Regulations.  
Article 12 for the existent building in a block whose building capacity controlling indexes have exceeded the stipulations in the Blank 3-1, expansion is prohibited.
Within the scope of the planning area of the main urban area, the floors of the existent buildings shall not be increased.
Article 13 Based on the planning indexes verified by the municipal urban planning administrative competent department, and in accordance with the firefighting, sun exposure and transportation conditions, construction units shall make public greening and construct supporting facility for public¨Cbenefiting public facilities and supporting facilities for urban utilities ( such as public lavatory, and sanitation facility etc) on the street within the plot of the project or on the other plots appointed by the municipal urban planning administrative competent departments within the second ring road. For every increased 1m2 green space or facility land that constructed as required in the planning, 6m2 of floor area is permitted to increase in its development construction project. 
Article 14 the building¡¯s elevated layer area shall not be included in the greening land or other open space.
For the buildings whose elevated layer hasn¡¯t any form of enclosure for parking, greening or recreation of the residents, after verified by the municipal urban planning administrative competent departments, its floor area can be exclude from the plot ratio.
The arcade on the building on the 2 sides of the urban road shall have a width not smaller than 3.5m, and its overhead clearance height shall not be smaller than 3.6m. For those without any steps or obstacles, the floor area on the ground floor of the arcade can be excluded from the plot ratio.
Article 15 The renovation of dangerous and old buildings shall not move the foundation or increase floor area, layer or height etc.
