Building Setback

Chapter 7 Building Setback
Article 41 For the building along with the boundary of construction projects’ land, on the 2 sides of urban road, highway, river channel and railway, and on the boundary of the protection zone for power line, its setback distance shall meet the requirements of firefighting, floor prevention, power, greening and transportation safety, as well as the stipulations of this Article.
Article 42 the regulations on the road red line of building setback:
(I) the road red line distance of building setback shall not be smaller than what is stipulated in the Blank 7-1 when meeting the sun-exposing interval demand;
(II) the road red line distance of public building setback with gathering traffic and pedestrian flows, such as large-scaled shopping centers, cinemas, theaters, hotel, restaurants, preliminary school, middle school and kindergarten, shall meet the stipulations of the Blank 7-1, as well as the traffic and pedestrian flows evacuation demand;
(III) On the land behind the building setback for express way, high arbors shall be planted as protection strip. For the buildings and the road interval that can’t meet the noise and pollution protection requirements, the principle of “the earliest construction goes first” shall be followed, and anti-noise facilities shall be set on building or roads.
Article 43 in residential communities and residential groups, the road edge distance of the building setback for the road uncontrolled with the planning red line shall not be smaller than what is stipulated in the Blank7-2.
Article 44 The construction project land boundary distance of the building setback for the unplanned road, shall meet the stipulations of sun-exposing interval, and shall not be smaller than what is stipulated in the Blank 7-3.
Article 45 When the other side of the construction land boundary is vacant land, building setback shall be determined assuming the other side is a multi-layered building; when the building that shall make setback forms a ≤30° angle with the building on the other side, the building shall make setback horizontally; when the building that shall make setback forms a >30° and ≤75° angle with the building on the other side, the setback distance of the building on the spot closest to the construction land boundary is 0.8 times of the horizontal setback distance; when the building that shall make setback forms a >75° angle with the building on the other side, the building shall make setback vertically.
Article 46 For the roads controlled with planning red line, the setback for the road red line shall be made according to the Article 42; for the road whose isolation strip has been controlled with green line, it shall be executed according to planning green line’s controlling demand; for the road not controlled with planning red line or green line, the width of its isolation strip shall be stipulated as follows:
(I) confirmed as respectively 50m away on the 2 sides of national road and high-leveled roads according to the status quo and planning;
(II) Respectively 20m away on the 2 sides of main road;
(III) Respectively 10m away on the 2 sides of secondary road and lower-leveled roads.
Within the road planning controlling red line and isolation strip, no building shall be newly-built, re-built or expanded. However, within the isolation strip of road, farming or afforestation can be done, and after approved by urban planning administrative competent departments, some activities can be done including ditch excavation, pipeline laying, pole line erection, or service-oriented driveway opening etc.
Article 47 the stipulations on the building setback for overpass and road intersection:
(I) building setback for overpass and road intersection shall not be smaller than the stipulations of the Blank 7-4;
(II) High-rise building’s setback distance shall also meet the requirements of sun-exposing interval and transportation evacuation.
Article 48 the building setback distance for the natural river channel, artificial ditch, and their supporting facilities that need to be reserved for a long term according to planning shall be in compliance with the relevant planning and laws, regulations, and rules, as well as the stipulations of the Blank 7-5.
Article 49 the stipulations for the building setback for railway:
(I) as to the building setback distance away from the side track on the closer side, if it’s a standard-gage artery, it shall be ≥30m; if it’s a standard-gage branch line or a special line, it shall be 20m; if it’s a meter-gage railway, it shall be ≥15m;
(II) The enclosing wall‘s distance from the side track of the closer side of the railway is≥10m, and the enclosing wall’s height is ≤2.5m;
(III) the distance from the side track on the closer side of the railway of high-rise building, high structures (water tower, chimney etc),warehouse and factory building for dangerous substances shall meet the relevant stipulations of railway management, so shall the construction activities close to the railway crossing;
(IV) The isolation strip width of special section shall be determined by urban planning administrative competent departments together with railway departments..
Article 50 the stipulations on the building setback for power lines:
(I) building setback distance for the overhung power line shall not be less than what is stipulated in the Blank 7-6;
(II) Building setback distance away from the same-side edge of the underground power passage shall not be less than 0.75m.
Article 51 building setback distances for the areas requiring special protections such as radio transceiver station etc shall be executed according to the approved sub-area planning and specific planning.

第七章  建筑退让
 
第四十一条  沿建设项目用地边界和城市道路、公路、河道、铁路两侧及电力线路保护区边界的建筑物,其退让距离除应当满足消防、防汛、电力、绿化和交通安全等要求外,还应当符合本章的规定。
第四十二条  建筑退让道路红线规定:
(一)建筑退让道路红线距离在满足日照间距的同时,不得小于表7-1的规定;
(二)大型商场、影剧院、宾馆、饭店、中小学、幼儿园等人流、车流聚集的公共建筑退让道路红线距离除符合表7-1的规定外,还应当同时满足人流、车流疏散的要求;
(三)建筑退让快速路后的用地应当种植高大乔木作为防护林带。建筑物与道路间距不能满足噪声污染防护要求的,应当按照后建服从先建的原则,在建筑物或者道路上设置防噪声设施。
第四十三条  在居住小区、居住组团内,建筑退让无规划道路红线控制的道路边缘距离不得小于表7-2的规定。
第四十四条  建筑物退让无规划道路的建设项目用地边界距离在满足日照间距规定的同时,不得小于表7-3的规定。
第四十五条  当建设用地界线另一侧为空地时,建筑退让按另一侧为多层建筑退让;当应当退让建筑与另一侧建筑成≤30°夹角时,建筑按平行布置退让;当应当退让建筑与另一侧建筑的夹角>30°且≤75°时,建筑物离建设用地界线最近点退让距离为平行布置时退让距离的0.8倍;当应当退让建筑与另一侧建筑成>75°夹角时,建筑按垂直布置退让。
第四十六条  已有规划红线控制的公路,按照本规定第四十二条规定退让道路红线;已有绿线控制公路隔离带的,按照规划绿线控制要求执行;没有规划控制红线和绿线控制的公路,其隔离带宽度规定如下:
(一)现状及规划确定为国道、高等级公路的两侧各50m;
(二)主要公路两侧各20m;
(三)次要公路及以下等级公路两侧各10m。
在公路规划控制红线和隔离带内,不得新建、扩建、改建任何建筑物,但在公路隔离带内可以耕种或绿化造林,经城市规划行政主管部门和相关部门批准后,也可以进行开挖沟渠、埋设管道、架设杆线或开辟服务性车道等活动。
第四十七条  建筑退让立交桥和道路交叉口的规定:
(一)建筑退让立交桥和道路交叉口不得小于表7-4的规定;
(二)高层建筑的退让距离还应当同时满足日照间距和交通疏散的要求。
第四十八条  建筑退让按照规划需长期保留使用的天然河道、人工河渠及其附属设施的距离,在符合有关规划和法律、法规、规章的同时,还应当符合表7-5的规定。
第四十九条  建筑退让铁路的规定:
(一)建筑退让与最近一侧的铁路边轨距离,准轨干线≥30m;准轨支线、专用线≥20m;米轨≥15m;
(二)围墙与铁路最近一侧边轨距离≥10m,围墙的高度≤2.5m;
(三)高层建筑、高大构筑物(水塔、烟囱等)、危险品仓库和厂房与最近一侧的铁路边轨距离以及在铁路道口附近进行建设活动应当符合铁路管理的有关规定;
(四)特殊路段隔离带宽度由城市规划行政主管部门会同铁路部门确定。
第五十条  建筑退让电力线路的规定:
(一)建筑退让架空电力线路的距离不小于表7-6的规定;
(二)建筑退让地下电力通道同侧边缘应当不小于0.75m。
第五十一条  建筑退让无线电收发信台保护区等需特殊保护区域的距离,按照批准的分区规划和详细规划执行。
