Building Height Control, Urban Road

Chapter 8 Building Height Control
Article 52 building’s height shall meet the requirements of fire-fighting, safety, and sun exposure etc, as well as the stipulations of this Article.
Article 53  In the surroundings, passage way and view corridors of the special facilities with overhead clearance height and signal path limitation, such as airport, observatory, radio station and other telecommunication facilities (including micro-wave communication), the height of the newly-built, rebuilt and expanded buildings shall meet the relevant stipulations on overhead clearance height, passage way limitation and view corridor.
Article 54 for the newly-built, rebuilt and expanded buildings within the construction controlling zones around the officially protection sites and buildings, their height shall be executed according to the relevant stipulations on cultural relics and historic site protections. For those without protective planning, a protective planning shall be formulated, after examined and approved by urban planning administrative competent departments and cultural competent departments, and executed according to the planning.
In the scenic spots of Xishan Mountain, Lake Dian (including Grass Sea), Lake Cui, Yuantongshan Mountain, EXPO Park etc, the newly-built, rebuilt and expanded buildings around the urban parks, shall meet the requirements of block planning, landscape planning and relevant stipulations, and their height shall ensure the full view of view corridor.
Article 55 The height of the newly-built, rebuilt and expanded buildings along with the 2 sides of urban road, shall meet the stipulations of Article52, 53 and 54, and the building height(H) shall not exceed the  1.2 times of the sum of width of road planning red line (W) and the building setback distance (S), namely :H≤1.2(W+S)(as shown in the Illustration 1).
Article 56 for the buildings set along with the whole line of landscape river channel and Panlong Rive, building’s height (H), shall not exceed the setback river channel distance (S), namely: H≤S (as shown in the Illustration 2).
 
Chapter 9 Urban Road and Municipal Pipeline Engineering
Article 57 urban road planning and construction shall take the corresponding urban planning’s the accordance, connect with the relevant professional planning, in accordance with the overall planning, comprehensive development, and supporting construction, comprehensively organize the construction, avoid repeated excavation of roads, and meet the relevant specifications and the Regulations.

(III) For the urban road whose road red line width is ≥40m, and belongs to public traffic artery, a public traffic special lane shall be equipped;
(IV) for the road whose road red line width is ≥30m, when the urban road crossed at grade with other urban secondary artery or a road of an senior level, the number of entry driveways shall be larger than the number of driveways on the section of the direction, and the increased driveway length shall extend forward by not less than 50m from the end point of the curb radius at the crossing point.
Article 61 when the interior road in the construction land connects with urban road, its grade change point shall not enter into the urban planning road red line.
Article 62 The newly-built and rebuilt urban bridges shall meet the requirements of bridge designing specification, and abide by the following stipulations:
(I) the clearance width of the newly-built and rebuilt bridges shall not be smaller than the width of planning road red line;
(II)bridge designing shall consider municipal pipeline laying and flood prevention requirements, the flammable, combustible and explosive engineering pipeline shall not use the transportation bridges to cross the river channel;
(III) The cross section allocation of the bridges shall be consistent with the planned road cross section;
(IV) The overhead clearance height of the bridges crossing railway, urban artery and secondary artery shall be≥5m.

第八章  建筑物高度控制
 
第五十二条  建筑物的高度除应当符合消防、安全、日照等要求外,还应当同时符合本章的规定。
第五十三条  在有净空高度和信号通道限制的飞机场、气象台、电台和其他无线电通讯(含微波通讯)等特殊设施周围和通道、景观视廊上,新建、扩建和改建建筑物的高度应当符合有关净空高度、通道限制和景观视廊的规定。
第五十四条  在文物保护单位和保护建筑周围的建设控制地带内新建、改建、扩建建筑物,其高度应当按照文物保护和历史街区保护的有关规定执行。无保护性规划的,应当编制保护性规划,经城市规划行政主管部门会同文化主管部门审核批准后,按照规划执行。
在西山、滇池(含草海)、翠湖、圆通山、世博园等风景名胜区、城市公园周边新建、改建、扩建建筑物的,应当符合片区规划、景观规划和有关规定的要求,其高度应当确保景观视廊的通视。
第五十五条  沿城市道路两侧新建、扩建、改建建筑物的高度除符合本规定第五十二、五十三、五十四条的规定外,建筑高度(H)不得超过道路规划红线宽度(W)与建筑退让距离(S)之和的1.2倍,即:H≤1.2(W+S)(见附图1)。
第五十六条  建筑沿景观河道和盘龙江全线布置,建筑的高度(H),不得超过建筑退让河道距离(S),即:H≤S(见附图2)。
 
第九章  城市道路及市政管线工程
 
第五十七条  城市道路规划和建设应当以相应的城市规划为依据,与相关专业规划相衔接,按照全面规划、综合开发、配套建设的原则,综合组织施工,避免重复开挖道路,并符合有关规范和本规定。
第五十八条  本章所指市政管线为:埋(架)设于城市道路下(上)的给水管道、排水管(渠)道、再生水管道、电力线路(包括电缆和架空电线)、电信线路(包括通信电缆和光缆、广播电视线路)、燃气管道等地上及地下管线及其附属设施。
第五十九条  各项市政管线工程的规划和建设,应当根据城市建设和改造的发展需要,在城市基础设施各专业系统规划的指导下,根据全面规划、综合开发、配套建设的原则,做到与城市道路的规划和建设紧密结合,按照地区及道路沿线进行综合平衡,统筹安排;应当遵循先地下后地上,先深埋后浅埋的科学建设程序,综合组织施工,避免重复开挖。
新建和有条件的现状城市道路,应当建设管线综合管沟或隧道,避免道路重复开挖。
第六十条  新建、改建城市道路工程,应当符合相关规范及以下规定:
(一)应当符合城市规划确定的道路红线、竖向标高和横断面分配;
(二)应当设置方便残疾人使用的无障碍设施,并确保通畅;
(三)道路红线宽度≥40m,且属于公交主干线的城市道路,宜设置公交专用道;
(四)道路红线宽度≥30m,且城市道路与其它城市次干路及以上等级的道路平面交叉时,进口车道数宜大于该方向路段车道数,所增加的车道长度应当自交叉口缘石半径的端点向前延伸不小于50m。
第六十一条  建设用地内部道路与城市道路相接时,其变坡点不得进入城市规划道路红线内。
第六十二条  新建、改建城市桥梁应当符合桥梁设计规范要求,并遵循以下规定:
(一)新建、改建桥梁净宽度不得小于规划道路红线宽度;
(二)桥梁设计应当考虑市政管线布设和防洪要求,可燃、易燃、易爆工程管线不宜利用交通桥梁跨越河道;
(三)桥梁的横断面划分应当与规划道路横断面一致;
(四)跨越铁路、城市主次干路的桥梁净空高度≥5m。
