Village and Town Planning

Chapter 10 Village and Town Planning
Article 70 For the village and town construction within the urban planning area, a village and town planning shall e firstly formulated, which shall be in compliance with general urban planning, sub-area planning, and controlling specific planning. And the planning shall be implemented after approved.
Article 71 for the house construction in rural area, planning in unity, examination & approval in unity, and construction in unity are conducted based on villager team and senior organizations. The new village construction and old village rebuilding shall be made simultaneously. The multi-layered apartment-style residence accounts for the major part, and it’s prohibited to newly build single-door independent residence.
Article 72 the house-construction in the rural area shall abide by the following stipulations in addition to village and town planning:
(I) The land is in compliance with the stipulations of urban planning, land utilization planning, and relevant laws, regulations and rules;
(II) The land to be constructed shall not occupy road, and other public lands etc;
(III) It shall meet the safety, sanitary and firefighting requirements etc.
 
Chapter 11 Supplementary Provisions
Article 73 Glossary.
Building interval: the minimum horizontal distance between the vertical projections on the exterior side of the neighboring buildings
Building height: the height from the building’s outdoor ground to the top of parapet. For the building with a sloping roof, when the gradient is less than 40°, the building height is the height from the outdoor ground to the eaves; when the gradient is less than 40°(including 40°), the building height is the height from the outdoor ground to the ridge.
Road red line: the boundary line of the planned urban road.
Building setback: the distance between the building’s exterior-side vertical projection and the road red line or land boundary.
Building land: the sum of the building basemen’s area and the reasonable surrounding area (including the green space and path between buildings). Generally it’s the area enclosed with planned urban road red line (or the boundary line of the land).
Building density: within a plot, the proportion of the total area of all buildings’ basement to the buildings’ land area (shown in percentage).
Plot ratio: within a plot, the proportion of the aboveground total floor area to the building’s land area.
Greening ratio: within a plot, the proportion of the greening area calculated according to specifications and the Regulations to the building’s land area (shown in percentage).
Low-rise building: it means the buildings whose height≤10m, low-rise residential building usually has 1 to 3 floors.
Multi-layered building: it means the buildings whose height>10m and ≤24m; multi-layered residential building usually has 4 to 6 floors.
Mid high-rise building: it means the residential building that has 7 to 9 floors.
High-rise building: it means the building whose height>24m; high-rise residential building usually has over 10 floors.
Podium: it means the multi-layered and low-rise building closely connected with a high-rise building to form a whole. The maximum height of podium doesn’t exceed 24m, and those whose height exceeds 24m are taken as high-rise buildings.
Second ring road: it means the east, north and west road, and the south transit artery on the second ring of Kunming main urban zone (the section from Shihuguan to Mingbo Overpass).
Express way: the road serving urban long-distance motor vehicles’ transportation. It has central separation strip in the middle, with over 4 driveways that control vehicle access with fly-over crossing, and control the exit of the buildings on the 2 sides.
Main artery: it’s also called as municipal artery, affording the main transportation connection among different urban areas, groups and intercity transportation hubs, functioning as the main transportation road in urban road network.
Secondary artery: the road that connects with the main artery to form a road network, functioning as a transportation distribution road with service function.
Sub-road: the road connected with block road, affording regional transportation, and oriented on service function.
Residential District: it refers in general to the settlements of different residential population scales, and refers specifically the residential settlement enclosed with urban artery or natural boundary line, corresponding to residential population scale (the populations of 30000-50000), and equipped with a whole set of well-developed public service facilities meeting the material and cultural demands of the residents in this area.
Residential Community: It means the residential settlement enclosed with urban road or natural boundary line, corresponding to residential population scale (the populations of 10000--15000), and equipped with a set of public service facilities meeting the basic material and cultural demands of the residents in this area.
Residential Group: It means the residential settlement separated with community road, corresponding to residential population scale (the populations of 1000--3000), and equipped with basic-leveled public service facilities needed by the residents in this area.
Gable: it means the architectural form that the building facing urban road takes the road-neighboring parts of its ground level or the first and second levels as pedestrian passageway in the form of colonnade.
Article 74 the construction engineering whose planning designing conditions have been verified by the municipal urban planning administrative competent departments, whose detailed planning has been approved, or whose “Planning Permit for Construction Engineering” has been acquired before the implementation of the Regulations, shall still be executed according to the original approval documents.
Article 75 The Regulations’ blanks, appendix and graphs have the same effects with the text of the Regulations.
Article 76 The contents not involved in the Regulations shall be executed according to the relevant state technical specifications or regulations.

第十章  村镇规划
 
第七十条  在城市规划区内的村镇建设,应当首先编制村镇规划,村镇规划应当符合城市总体规划、分区规划和控制性详细规划,经批准后,按规划实施。
第七十一条  农村建房以村民小组及以上组织为基本单位实行统一规划、统一审批、统一建设,新村建设与旧村改造应当同步进行,以多层公寓式住宅为主,禁止新建单户独院式住宅。
第七十二条  农村建房在符合村镇规划的前提下,还应当满足下列规定:
(一)用地符合城市规划、土地利用规划和有关法律、法规、规章规定;
(二)拟建位置不得占用道路、其他公共用地等;
(三)符合安全、卫生、消防等要求。
 
第十一章   附 则
 
第七十三条  名词解释。
建筑间距:相邻建筑物外侧垂直投影之间的最小水平距离。
建筑高度:建筑物室外地坪至女儿墙顶的高度。对于坡屋顶建筑,当坡度小于40?,建筑高度为室外地坪至檐口的高度;当坡度大于40°(含40°)时,建筑高度为室外地坪至屋脊的高度。
道路红线:规划的城市道路路幅的边界线。
建筑后退:建筑物外侧垂直投影线距道路红线或用地边界的距离。
建筑用地:建筑基底占地及其四周合理间距内(含建筑间的绿地和小路)的总和。一般为规划城市道路红线(或用地边界线)围合的用地。
建筑密度:一定地块内,所有建筑物的基底总面积占建筑用地面积的比例(用百分比表示)。
容积率:一定地块内,地上总建筑面积与建筑用地面积的比值。
绿地率:一定地块内,按规范和本规定计算的绿地面积与建筑用地面积的比例(用百分比表示)。
低层建筑:指高度≤10m的建筑,低层居住建筑为一层至三层。
多层建筑:指高度>10m且≤24m的建筑;多层居住建筑为四层至六层建筑。
中高层建筑:指层数为七至九层的居住建筑。
高层建筑:指高度大于24m的建筑;高层居住建筑为十层以上建筑。
裙 房:指与高层建筑紧密连接,组成一个整形的多、低层建筑。裙房的最大高度不超过24m,超过24m的按高层建筑处理。
二环路:指昆明主城区二环东、北、西路及南过境干道(石虎关至明波立交桥段)。
快速路:是为城市长距离快速机动车交通服务的道路,中间设有中央分隔带,布置有四条以上的车道,全部采用立体交叉控制车辆出入,并对两侧建筑物的出口加以控制。
主干路:又称全市性干道,负担城市各区、组团以及对外交通枢纽之间的主要交通联系,在城市道路网中起主要交通运输作用。
次干路:是与主干路结合组成道路网,起集散交通的作用,兼有服务功能的道路。
支 路:是与街坊路的连接线,解决局部地区交通,以服务功能为主的道路。
居住区:泛指不同居住人口规模的居住生活聚居地和特指被城市干道或自然分界线所围合,并与居住人口规模(30000--50000人)相对应,配建有一整套较完善的、能满足该区居民物质与文化生活所需的公共服务设施的居住生活聚居地。
居住小区:是指被城市道路或自然分界线所围合,并与居住人口规模(10000--15000人)相对应,配建有一套能满足该区居民基本的物质与文化生活所需的公共服务设施的居住生活聚居地。
居住组团:是指被小区道路分隔,并与居住人口规模(1000--3000人)相对应,配建有居民所需的基层公共服务设施的居住生活聚居地。
骑 楼:指临城市道路的建筑将地面一层或一、二层两层临道路部分以柱廊形式用作人行通道的建筑形式。
第七十四条  在本规定施行前已取得市城市规划行政主管部门核定规划设计条件、批准详细规划,或已取得《建设工程规划许可证》的建设工程,仍按照原批准文件执行。
第七十五条  本规定的表格、附录、附图与本规定正文具有同等的效力。
第七十六条  本规定未涉及的内容按国家相关技术规范或相关规定执行。
